Terms of Service

Last updated

These terms govern your access to and use of LiveFTA, including this website, the LiveFTA platform, and the dashboards, reports and data extracts it produces. By creating an account or using LiveFTA, you agree to them. If you use LiveFTA for an organisation, you agree on its behalf and confirm you have authority to do so.

1. Who we are

LiveFTA is provided by Datalytics, a subsidiary of Saracen Marketing Group, based in Nairobi, Kenya ("Datalytics", "we", "us"). You can contact us through the details published at datalyticsafrica.com.

2. The service

LiveFTA records the publicly available YouTube live simulcasts of free-to-air television channels in Kenya, Uganda and Tanzania and presents audience figures, summaries of public reaction, analysis views, reports and data extracts ("Outputs").

If you or your organisation have signed a separate agreement with Datalytics for LiveFTA, that agreement prevails over these terms where they conflict, including on fees, scope and service levels.

3. Accounts

  • LiveFTA is a business service. You must be at least 18 to hold an account.
  • Give an accurate email address that you control, and keep it up to date.
  • Keep your password and sign-in links private. Accounts are for one person and must not be shared.
  • You are responsible for activity under your account. Tell us promptly if you believe it has been accessed without permission.
  • We may decline, suspend or close accounts that breach these terms or put the service or others at risk.

4. Acceptable use

You must not:

  • copy, scrape, crawl or systematically extract data from the platform other than through the exports it provides;
  • resell, sublicense or redistribute LiveFTA, its Outputs or its underlying data as a data product or service, unless we have agreed to it in writing;
  • reverse engineer, probe or attempt to bypass the platform's security, access controls or usage limits;
  • attempt to identify, contact, profile or target any individual from the public messages or comments reflected in LiveFTA;
  • use LiveFTA in a way that breaks the law or infringes anyone's rights;
  • interfere with the service or other users' access to it.

5. Figures and Outputs

  • YouTube audiences only. LiveFTA figures describe audiences watching on YouTube. They are not total television audience measurement and do not include over-the-air, cable, satellite or other viewing.
  • Recorded at intervals. Figures are readings taken at intervals and may be delayed, incomplete or interrupted, for example when a channel's stream or a data source is unavailable. Where there is too little data to report honestly, LiveFTA says so rather than estimating.
  • Automated analysis. Sentiment measures and written summaries are produced automatically. They describe overall tendencies and can be wrong about the tone or meaning of particular messages.
  • Your decisions. Outputs support your judgement; they do not replace it. You are responsible for decisions you make using them, including media planning, buying and editorial decisions.

6. Using Outputs

Subject to these terms and any agreement you hold with us, you may use Outputs within your organisation and share them with your own clients or partners as part of your work, for example in a presentation or a media plan. Where you quote LiveFTA figures outside your organisation, attribute them to LiveFTA and do not present them as total audience measurement.

7. YouTube and third parties

  • LiveFTA uses YouTube API Services. By using LiveFTA you agree to be bound by the YouTube Terms of Service, and information collected through YouTube API Services is subject to the Google Privacy Policy.
  • LiveFTA is independent. It is not affiliated with, endorsed by or sponsored by YouTube, Google or any broadcaster it tracks.
  • Channel and broadcaster names belong to their owners and are used only to identify the channels LiveFTA reports on.

8. Ownership

Datalytics and its licensors own LiveFTA, including its software, design, methods, analysis and the compiled database behind it. Apart from the rights to use Outputs in section 6, these terms do not give you any rights in LiveFTA. If you send us feedback, we may use it without obligation to you.

9. Privacy

Our Privacy Policy explains how we handle personal data, including account data and public posts reflected in LiveFTA.

10. Fees

Access to the LiveFTA platform may be subject to fees set out in a separate agreement or order with Datalytics. Unless that agreement says otherwise, fees are payable as invoiced and are exclusive of applicable taxes.

11. Availability and changes

We work to keep LiveFTA available and accurate, but unless a separate agreement says otherwise we do not guarantee uninterrupted availability. We may change, add or remove features, channels or markets, and we may suspend the service for maintenance, security or reasons outside our control, such as changes to third-party platforms.

12. Ending use

You may stop using LiveFTA at any time. We may suspend or end your access if you breach these terms, if required by law, or if we stop offering LiveFTA, giving notice where reasonably possible. Sections 5, 8, 13, 14 and 16 continue after access ends.

13. Disclaimers

To the extent the law allows, LiveFTA and its Outputs are provided "as is" and "as available", without warranties of any kind, including warranties of accuracy, completeness, fitness for a particular purpose or uninterrupted operation. Nothing in these terms excludes rights you have that cannot be excluded by law.

14. Limitation of liability

To the extent the law allows, Datalytics is not liable for indirect or consequential loss, or for loss of profits, revenue, business, goodwill or data, arising from your use of LiveFTA or its Outputs. Our total liability arising out of or in connection with LiveFTA in any twelve-month period is limited to the fees you paid us for LiveFTA in that period. Nothing in these terms limits liability that cannot be limited by law, including for fraud.

15. Your responsibility to us

You will compensate Datalytics for reasonable losses and costs arising from a claim by a third party that results from your breach of section 4 or your unlawful use of LiveFTA.

16. Governing law

These terms are governed by the laws of Kenya. The courts of Kenya have jurisdiction over any dispute arising from them, although we will first try to resolve any concern with you directly.

17. Changes to these terms

We may update these terms. We will change the date at the top of this page, and where changes are significant we will tell account holders by email before they take effect. Continuing to use LiveFTA after changes take effect means you accept them.
